Terms and conditions of use

TERMS AND CONDITIONS OF USE OF WWW.TOP-FLOWERS.COM

By placing an order through the online system of www.top-flowers.com, the customer declares that they have read, understood and accepted these Terms and Conditions governing the sale of goods and services offered by TF GROUP 2009 Ltd.

1. OBLIGATIONS AND ADDITIONAL PAYMENTS

1.1. When purchasing products from www.top-flowers.com, the customer agrees to pay the value of the selected products, as well as any applicable delivery charges displayed during the checkout process.

1.2. When using payment systems, bank transfers, cash on delivery or other payment methods, any fees charged by the respective payment institutions or intermediaries shall be borne by the customer unless expressly stated otherwise.

1.3. All prices displayed in the online store are final, stated in Euro (€) and include VAT unless otherwise specified.

2. DELIVERY AND COLLECTION OF PRODUCTS

2.1. Products may be collected in person after a prior order has been placed and confirmed by a Top Flowers representative.

2.2. For deliveries outside Sofia, TF GROUP 2009 Ltd uses third-party courier services and reserves the right to select the courier company at its sole discretion.

2.3. The customer is responsible for providing accurate and complete delivery and contact information.

2.4. TF GROUP 2009 Ltd shall not be liable for delays caused by force majeure events, courier service disruptions, natural disasters, public holidays, technical issues or incorrect information provided by the customer.

2.5. A delivery shall be deemed completed upon handover of the product to the recipient, a designated person, reception desk, security personnel, colleague, relative or any other person present at the delivery address in accordance with the instructions provided.

2.6. If the recipient is absent, TF GROUP 2009 Ltd may deliver the product to another person present at the delivery address who agrees to accept the delivery.

2.7. For anonymous deliveries, TF GROUP 2009 Ltd shall not be liable for the recipient's inability to identify the sender or for any consequences arising from the sender's decision to remain anonymous.

2.8. If the recipient refuses to accept the delivery, the order shall be deemed fulfilled by the seller. The customer shall not be entitled to reimbursement of the value of perishable goods used, delivery costs, production costs or administrative expenses.

3. WEBSITE USAGE

3.1. To place an order, the customer must provide valid and up-to-date contact details. Billing information is required only when an invoice is requested.

3.2. Personal data is processed in accordance with applicable legislation and the Company's Privacy Policy.

3.3. TF GROUP 2009 Ltd does not guarantee uninterrupted operation of the website and shall not be liable for temporary service interruptions.

4. COMPLAINTS, RIGHT OF WITHDRAWAL AND REFUNDS

4.1. Customers are entitled to submit a complaint if the delivered product does not conform to the sales agreement.

4.2. Complaints should preferably be submitted within 24 hours of delivery and accompanied by photographic evidence.

4.3. Complaints relating to damage resulting from improper storage, handling, maintenance or any action or omission by the customer or recipient after delivery shall not be considered.

4.4. Responsibility for proper storage, maintenance and care of the product passes to the recipient upon delivery.

4.5. TF GROUP 2009 Ltd reserves the right to document the preparation and delivery of products by means of photographs. Such photographs may be used in the investigation of complaints and dispute resolution procedures.

4.6. If no objection regarding visible damage, missing items or non-conformity is raised at the time of delivery, the product shall be deemed accepted as compliant with the sales agreement.

4.7. Pursuant to Article 57, Item 4 of the Bulgarian Consumer Protection Act, the right of withdrawal does not apply to goods which are liable to deteriorate or expire rapidly.

4.8. Fresh flowers, bouquets, floral arrangements, baskets containing live flowers and all products containing natural flowers are considered perishable goods and are not eligible for return based on a change of mind after delivery.

4.9. The provisions above do not limit the customer's right to submit a complaint where a lack of conformity exists.

4.10. The following shall not be considered non-conformity:

4.11. In the event of temporary unavailability of flowers, greenery, packaging, decorative elements or gift items, TF GROUP 2009 Ltd reserves the right to replace them with equivalent or higher-grade alternatives without prior notice.

4.12. Where a withdrawal request is submitted through the website regarding products falling under the exemptions of Article 57 of the Consumer Protection Act, including fresh flowers and floral arrangements, the request shall be treated as a customer enquiry or complaint where applicable.

4.13. Refunds for payments made by bank card shall be processed through the original payment instrument or in accordance with the requirements of the relevant payment provider.

4.14. Refunds for payments made via bank transfer, PayPal, ePay, EasyPay or other payment methods shall be processed through the same or another mutually agreed method.

4.15. For custom-made products, special orders, personalised arrangements, specially sourced flowers or products ordered specifically for the customer, refunds may be refused in whole or in part depending on the costs incurred.

4.16. TF GROUP 2009 Ltd reserves the right to reject a complaint where available evidence indicates abuse of rights, bad faith or an attempt to obtain unjustified compensation.

5. PRODUCTS AND PRODUCT DESCRIPTIONS

5.1. Product photographs displayed on www.top-flowers.com are illustrative in nature. Top Flowers makes every effort to ensure that delivered products correspond as closely as possible to the displayed images.

5.2. Due to the natural characteristics of flowers, minor variations in colour shades, flower size, blooming stage and arrangement composition may occur.

5.3. The natural nature of flowers implies seasonal variations in size, colour shades, blooming stage, shape and longevity.

5.4. Any component of a published product may be substituted with a similar or higher-grade alternative where necessary.

5.5. During peak periods, including Valentine's Day, International Women's Day (8 March), Christmas, New Year and other busy occasions, delivery time variations and substitutions of certain elements with equivalent alternatives may occur.

6. WEBSITE CONTENT

6.1. All texts, images, graphics, logos and other content published on the website are protected by copyright.

6.2. Their use without the prior written consent of TF GROUP 2009 Ltd is prohibited.

7. AMENDMENTS TO THE TERMS AND CONDITIONS

7.1. TF GROUP 2009 Ltd reserves the right to amend these Terms and Conditions at any time.

7.2. Any amendments shall enter into force upon publication on the website unless expressly stated otherwise.
